Donald Trump brags about overturning Roe v. Wade and has even said that women should face “punishment” for obtaining reproductive health care. If he returns to the White House, he is planning to ban abortion nationwide, with or without the help of Congress. Joe Biden and Kamala Harris believe women should make their own health care decisions and are fighting for federal legislation to protect reproductive health care access in every state. 

As president, Donald Trump overturned Roe v. Wade, allowing MAGA Republicans in states across the country to ban reproductive health care. Because of Donald Trump, more than 1 in 3 women of reproductive age now live under an abortion ban in effect, many of which have no exceptions for rape or incest. Across the nation, MAGA Republicans are inserting themselves into the most personal decisions a family can make, from trying to restrict access to contraception to blocking IVF fertility treatments and preventing loving couples from growing their families. And Trump and MAGA Republicans want to go even further in 2024 and ban abortion nationwide – ripping away reproductive freedom in all 50 states. 

Joe Biden and Kamala Harris are working tirelessly to protect your right to make your own health care decisions. They are doing everything in their power to protect access to reproductive health care, speaking out against MAGA Republican attacks, and fighting to restore the protections of Roe v. Wade. And if Congress passes a national abortion ban, President Biden has promised to veto it. The future of our freedoms hangs in the balance in November: Joe Biden may be the only thing standing in the way of an  abortion ban next year, which is why reelecting Joe Biden is crucial to protecting reproductive rights and stopping a national ban.

What has the Biden-Harris administration done to protect the right to choose?

Protecting access to reproductive health care has been a priority since the beginning of the Biden-Harris Administration, made even more urgent by the Supreme Court’s decision to overturn Roe v. Wade. The President has signed three Executive Orders to protect access to reproductive health care, and he and the Vice President are overseeing a whole-of-government effort to protect reproductive rights, including :

  • Safeguarding access to abortion, including medication abortion: The Biden-Harris Administration is working to defend access to mifepristone, a safe and effective medication to end early pregnancy approved by the FDA more than twenty years ago. President Biden issued a Presidential Memorandum directing efforts to protect access to medication abortion, including to safeguard the safety and security of patients, providers, and pharmacies.  
  • Fighting to ensure access to emergency medical care: The Administration is committed to helping ensure all patients, including women who are experiencing pregnancy loss and other pregnancy-related emergencies, have access to emergency medical care required under the Emergency Medical Treatment and Labor Act (EMTALA). 
  • Expanding access to contraception: President Biden issued an Executive Order directing agencies to improve contraception access and affordability for women with private health insurance, promote increased access to over-the-counter contraception, and more.
  • Protecting patient privacy: The Administration issued a proposed rule to strengthen privacy protections, including reproductive health privacy, under the Health Insurance Portability and Accountability Act (HIPAA).
  • Defending a woman’s right to travel for medical care: On the day of the Supreme Court’s decision to overturn Roe v. Wade, President Biden reaffirmed the Attorney General’s statement that women must remain free to travel safely to another state to seek the care they need. 
What about IVF treatment?

The Alabama Supreme Court, made up entirely of Republican justices, recently issued a ruling that ripped away access to IVF treatment from many Alabama families — something that was only possible because Trump overturned Roe. In addition, over 120 congressional Republicans are co-sponsors of a radical bill that would put access to IVF treatment at risk nationwide. 

Joe Biden is committed to protecting IVF treatment. He issued a statement saying that MAGA Republicans’ “disregard for women’s ability to make these decisions for themselves and their families is outrageous and unacceptable.” 

What kind of national abortion ban are Republicans proposing?

MAGA Republicans have proposed multiple bills to ban abortion nationwide, and we know Trump and his MAGA Republican allies will stop at nothing to further restrict reproductive health care access ’ if they take power – Trump’s close allies have plans to unilaterally rip away access to abortion in all 50 states, with or without Congress’ help
