Joe Biden and Kamala Harris are fighting for the LGBTQ+ community. Donald Trump and his MAGA base demonize, attack, and endanger LGBTQ+ individuals and families.

This election, there’s so much at stake for members of the LBGTQ+ community—for their families, their freedoms, and their futures. 

While Donald Trump demonizes, attacks, and endangers LGBTQ+ individuals and families, Joe Biden believes that everyone should be treated with respect and dignity and be able to live without fear, no matter who they are or who they love.

Joe Biden protected the freedom of LGBTQ+ Americans to love who they love by signing the Respect for Marriage Act. He is strengthening civil rights protections, signing historic executive orders to prevent and combat discrimination against LGBTQ+ Americans, and fighting to enact the Equality Act, calling on Congress in every State of the Union to enshrine more anti-discrimination protections in public accommodations, housing, education, credit, employment, and more into law.

Donald Trump gutted Obama-Biden anti-discrimination protections for LGBTQ+ Americans, appointed judges who oppose same-sex marriage, and banned transgender soldiers from serving in the military (which Joe Biden reversed!).

Joe Biden strengthened the Affordable Care Act (ACA) to ensure LGBTQ+ communities can access the health care they need. The Biden-Harris Administration strengthened protections against discrimination based on sexual orientation and gender identity in health care and health insurance and increased enrollment in the ACA for LGBTQ+ Americans, including by lowering premiums by $800 per year, increasing outreach, and more.

Donald Trump wants to repeal the Affordable Care Act, increasing costs and ripping away protections from LGBTQ+ Americans. He overturned Roe, jeopardizing access to IVF in states across the country, and wants to rip away freedoms in all 50 states by banning abortion nationally. And he’s running on an extreme plan to punish doctors who treat transgender youth and to ban gender affirming care for minors. 

Donald Trump turned his back on LGBTQ+ Americans, and he plans to set back their long march towards equality even further. Don’t give him the chance.

What has Joe Biden done to support to transgender kids and their families?

Much of the Biden-Harris Administration’s historic work to advance equality for transgender Americans has involved standing up for transgender children and their families by:

  • Supporting transgender students in our nation’s schools. Joe Biden signed an Executive Order recommitting the federal government to fully abide by federal laws that guarantee educational environments free from sex discrimination, including discrimination on the basis of sexual orientation or gender identity. 
  • Signing a historic Executive Order to advance equality for LGBTQ+ people, especially children and families. Joe Biden signed a historic Executive Order on Advancing Equality for LGBTQ+ Individuals, establishing that it is the Administration’s policy to defend the rights and safety of LGBTQ+ individuals.
  • Intervening legally when states violate the rights of transgender youth and their families. The Department of Justice (DOJ) has filed multiple statements of interest and amicus briefs supporting litigation against state laws that restrict the rights of transgender youth in matters related to access to gender-affirming health care and sports, for example. 
  • Expanding mental health resources for transgender youth. The Substance Abuse and Mental Health Services Administration (SAMHSA) added dedicated services for LGBTQ+ youth to the national 988 Suicide and Crisis Lifeline, the nationwide suicide prevention and crisis hotline. The service helps LGBTQ+ youth, including transgender youth, experiencing a behavioral health crisis connect with a trained counselor specifically focused on meeting the needs of LGBTQ+ youth and young adults.
  • Clarifying that LGBTQ+ youth are entitled to support and affirmation in the child welfare system. In response to at least one state launching child abuse investigations into the loving families of transgender children, Joe Biden condemned these investigations as callous government overreach that threatens families. In addition, the Department of Health and Human Services released guidance to state child welfare agencies through an Information Memorandum. This memorandum makes clear that states cannot weaponize their child welfare systems against loving families and should instead use their child welfare systems to advance safety and support for LGBTQ+ youth, which, importantly, can include access to gender-affirming care. Finally, HHS worked with partners to launch a web portal of resources for child welfare personnel to support families of children who identify as LGBTQ+.
How would a second Trump term impact LGBTQ+ Americans?

It’s easy to imagine how Donald Trump would approach LGBTQA+ issues if reelected; just consider the harm he caused during his first term. During his 4 years in office, Donald Trump:

  • Gutted Obama-Biden anti-discrimination protections for LGBTQ+ Americans;
  • Appointed judges who oppose same-sex marriage;
  • Banned transgender soldiers from serving (Which Joe Biden reversed!);
  • Tried to repeal the ACA, increase costs, and rip away protections for LGBTQ+ Americans; and
  • Overturned Roe, stripping reproductive care from millions of Americans and jeopardizing access to IVF in states across the country.

And Trump has even more cruel plans in place for a second term agenda. His close allies have published the blueprint for a second Trump term: “Project 2025,” outlining in explicit detail cruel, regressive proposals that threaten the freedoms of LGBTQ+ Americans. These include:

  • Establishing marriage between a man and a woman as the “ideal, natural family structure”;
  • Banning gender-affirming care for minors;
  • Limiting LGBTQ+ workplace discrimination protections;
  • Reinstating a military ban for transgender soldiers;
  • Rescinding health care protections for transgender people; 
  • Urging Congress to define gender as male and female, fixed at birth; and
  • Appointing Supreme Court justices in the mold of Clarence Thomas, who called for revisiting Obergefell

It’s clear that Trump is trying to stop any and all acknowledgement of an acceptance of gender identity and LGBTQ+ people, period.

How has Joe Biden protected LGBTQ+ people from discrimination?

On his very first day in office, Joe Biden signed his Executive Order on Preventing and Combating Discrimination on the Basis of Gender Identity or Sexual Orientation. This order sent a clear message:Joe Biden is here to look after those who have slipped through the cracks of legal protection for too long.

Joe Biden took this a step further in 2024, finalizing rules under Title IX to explicitly forbid discrimination based on sexual orientation or gender identity under federal law. He’ll never stop fighting to protect the freedom of LGBTQ+ Americans to love who they love and show up as their authentic selves.
